How The New Labour Government Will Affect the Legal Sector
The UK's criminal justice system has faced mounting challenges in recent years, with court backlogs reaching unprecedented levels and public confidence waning. Now, however, with the Labour Party at the helm of the UK Government, Prime Minister Sir keir
Starmer has articulated a series of comprehensive plans aimed at revitalising the system.
In this blog, we'll explore how the Labour Government is set to transform the legal sector, particularly focusing on their strategies to address court backlogs and broader criminal justice reforms.
Strengthening neighbourhood policing
Labour's vision is to rebuild public trust in the police, ensuring communities feel safe and supported, and as a result, they have promised to bolster neighbourhood policing with the recruitment of thousands of new officers in a move which aims to ensure that when citizens call the police, they will respond promptly, and when crimes are reported, they will be thoroughly investigated.
Also in an effort to combat antisocial behaviour, Labour plans to introduce new 'Respect Orders' which will empower authorities to ban persistent adult offenders from town centres. This measure aims to tackle public drinking, drug use and other disruptive behaviours that degrade community life.
And finally, Labour proposes that fly-tippers and vandals face immediate consequences and be made to clean up their messes, delivering immediate consequences for their actions and deterring future offenses.
Comprehensive review and new offences
Labour pledges to carry out a thorough review of sentencing to ensure it aligns with public expectations and effectively deters crime. Whilst this review is particularly focused on ensuring that sentences for offenses against women and girls are appropriate and impactful, Labour will also be outlining plans for new criminal offenses targeting assaults on retail workers, spiking and the criminal exploitation of children. This approach reflects Labour's commitment to addressing emerging threats and protecting vulnerable populations.
What’s more, Labour will ban dangerous weapons such as ninja swords, zombie-style blades and machetes, proposing new rules to prevent the online sale of these dangerous weapons, with executives of online companies held personally liable for breaches. The result is that any young people found in possession of knives will be referred to Youth Offending Teams and subjected to mandatory plans to prevent reoffending.
Supporting young people and preventing crime
Labour will introduce the Young Futures programme, which integrates youth workers, mental health support and career advisors to prevent young people from being drawn into crime with a new initiative that aims to tackle the root causes of youth crime by providing support and opportunities.
Also, in an effort to expedite justice in cases of sexual violence, Labour plans to fast-track rape cases in every Crown Court in England and Wales by introducing specialist rape investigation units in every police force to ensure early intervention and support for victims.
Protecting women and strengthening victim rights
Labour is committed to enhancing protections for women, particularly those in co-habiting relationships, by strengthening Stalking Protection Orders and giving women the right to know the identities of their online stalkers.
The powers of the Victims’ Commissioner will also be increased to offer greater protections for victims of crime and persistent antisocial behaviour, ensuring victims' voices are heard and their needs are prioritised within the criminal justice system.
Reforming the criminal justice system
Labour aims to address court backlogs by increasing prosecutorial capacity and making more available. They also propose allowing Associate Prosecutors to work on appropriate cases, thereby increasing the system's capacity to handle the influx of cases more efficiently.
What’s more, a strategic review of probation governance will be conducted, including consideration of devolved models that could improve the management and rehabilitation of offenders. And, as Labour recognises the critical issues within the prison system, such as overcrowding and insufficient rehabilitation programs, they also plan to use all relevant powers to build new prisons and improve existing facilities, ensuring that prisoners have access to educational and vocational training and creating pre-release plans to facilitate their reintegration into society.
Transparency and accountability
Labour will introduce a 'Hillsborough Law' that places a legal duty of candour on public servants and authorities, this being a law which aims to ensure transparency and accountability, particularly in the wake of disasters or state-related deaths, and within this, victims will be provided with legal aid to support their pursuit of justice.
And finally, Labour aims to reset the UK’s relationship with the EU, seeking to deepen ties while avoiding a return to the single market or customs union.
Through this strategy, they will work to remove unnecessary barriers to trade and improve the recognition of professional qualifications, helping UK businesses access international markets more effectively.
The Labour Government promise significant changes for the UK's legal sector, aiming to create a more efficient, fair and trustworthy system.
